1. About these terms
These Terms and Conditions apply when you use PhoneWorld.co or place an order through the website. They explain who we are, how orders are formed, how payment and delivery work, your cancellation and return rights, and the rules for using the website.
Please read these terms before ordering. By placing an order, you confirm that you have had an opportunity to read them. If you do not agree with the website-use provisions, you should not use the website.
These terms are intended mainly for consumers buying for personal use. If you are buying wholly or mainly for business purposes, please contact us before ordering because separate business terms may apply.
2. Who we are and how to contact us
PhoneWorld.co is operated by Phone World Ltd, registered in England and Wales under company number 11823435. Our registered office is Phone World, 1B West Street, Dunstable, England, LU6 1SL.
You can contact us through the Contact Us page, by telephone on 01582 671721, by writing to the registered office, or by using the monitored customer-service email address published in our Legal Notice. Please quote your order number when asking about an order.
3. Your account and information
You are responsible for providing accurate, complete and current information and for keeping your account password confidential. Tell us promptly if you believe your account has been used without permission. We may suspend an account where reasonably necessary to protect customers, investigate misuse or maintain website security.
If you are under 18, you should use the website and place an order only with the involvement of a parent or guardian who can lawfully enter into the contract.
4. Products and descriptions
We take reasonable care to describe products accurately. Product photographs are for illustration and screen settings can affect colour. Packaging, accessories and minor design details may change where this does not materially reduce the product's quality or functionality. The product page and order confirmation will identify the model, capacity, colour, condition and included items where relevant.
Compatibility depends on the device model, software, network, connector and region. Please check the product description or contact us before ordering if compatibility is important to you. We are not responsible for a product being unsuitable solely because information supplied by you was incomplete or incorrect, but this does not affect your rights if the product is faulty, not as described or not fit for a purpose made known to us.
5. New, pre-owned and refurbished devices
Where a product is pre-owned, refurbished, graded or open-box, its condition will be stated on the product page. Reasonable cosmetic signs of prior use may be present where consistent with the advertised grade. Battery performance can vary with age, settings and usage. Any specific battery-health promise, included accessory, network status or commercial warranty will be stated in the product description or warranty information.
Before using a device, check that it is compatible with your network and transfer or restore your data carefully. Manufacturer or network services, software updates, cloud accounts and third-party subscriptions are controlled by their respective providers and may have separate terms.
6. Prices and availability
Prices are shown in the currency selected on the website and include VAT where applicable, unless stated otherwise. Delivery charges and any optional extras are shown before you submit the order. Prices and promotions may change, but a change will not affect an order we have already accepted except where you agree to a correction.
All products are subject to availability. Placing an item in your basket does not reserve it. If an item is unavailable after you order, we may contact you to offer a suitable alternative, a revised delivery date or cancellation. We will not substitute an item or charge a higher amount without your agreement.
7. Placing an order and contract formation
The checkout gives you an opportunity to review and correct your basket, delivery details and total price before submitting the order. Your order is an offer to buy the listed products. We will acknowledge receipt electronically.
A contract is formed only when we send a dispatch confirmation, confirm that the goods are ready for collection, or otherwise expressly accept the order. Payment authorisation or an automated acknowledgement does not by itself mean that the order has been accepted. If we cannot accept an order, we will explain why where reasonably possible and release or refund any payment taken.
We may refuse or cancel an order before acceptance because a product is unavailable, a price or description contains an obvious error, payment is not authorised, the delivery address cannot be served, order limits are exceeded, or fraud and security checks identify a reasonable concern.
8. Payment and security checks
The payment methods currently available are displayed at checkout. Payments are subject to authorisation by the relevant bank or payment provider. Your provider may request additional identity verification, such as 3D Secure or another strong-customer-authentication step.
When you submit an order, your payment method may be authorised, reserved or charged depending on the method and provider. Your confirmation will show the payment status. We may carry out reasonable anti-fraud, address and identity checks and may contact you for information needed to complete them. 9. Delivery
Delivery options, estimates and charges are shown at checkout. We will deliver without undue delay and, unless a different period has been agreed, within 30 days after the contract is made. Delivery dates are estimates unless expressly guaranteed. Please see the Delivery page for address changes, tracking, missed delivery and damaged parcels.
The goods remain at our risk until they enter your physical possession or the possession of a person you identified to receive them, except where you independently appoint a carrier that we did not offer. Ownership passes after payment in full and delivery.
10. Your right to cancel an online order
For most goods bought online, you may cancel without giving a reason from the time the contract is made until 14 days after the day you, or a person you nominated, receives the goods. If one order is delivered in several instalments, the period normally runs from receipt of the final instalment.
To cancel, send us a clear statement through the Contact Us page, by email, by post or by using the model cancellation form below. Include your name, order number, contact details and the products you wish to cancel. It is enough to send the cancellation notice before the cancellation period ends.
11. Exceptions to cancellation
The legal right to change your mind does not apply in every case. Subject to applicable law, exceptions can include:
· goods made to your specifications or clearly personalised;
· sealed goods that are not suitable for return for health-protection or hygiene reasons once unsealed;
· sealed audio, video or computer software once unsealed;
· goods that become inseparably mixed with other items after delivery; and
· services fully performed after you expressly requested an early start and acknowledged that the cancellation right would be lost on full performance.
If you ask us to begin a service during the cancellation period and later cancel before completion, you may have to pay a proportionate amount for work properly carried out up to cancellation. Separate Repair Terms should be provided when a repair is booked.
12. Returning unwanted goods
After cancelling, you must return the goods within 14 days unless we agree to collect them. Contact us first for return instructions and the correct return address. Unless we state otherwise, you are responsible for the direct cost of returning unwanted goods. Phone World will pay reasonable return costs where goods are faulty, damaged on delivery or incorrect, once the return method has been agreed.
You must take reasonable care of the goods. You may handle them only as you would reasonably be allowed to do in a shop to establish their nature, characteristics and functioning. We may reduce a refund to reflect diminished value caused by handling beyond that level, where the law allows.
Use suitable protective packaging and obtain proof of postage. Remove personal accounts, activation locks, SIM cards and memory cards from a returned device, and back up any information you need. Do not send accessories containing lithium batteries by a method that does not accept them.
13. Refunds after cancellation
We will refund the price paid for cancelled goods and the cost of our least expensive standard delivery option. If you selected a more expensive delivery service, the additional amount is not refundable unless the goods were faulty or we failed to provide the agreed service.
We may withhold the refund until we receive the goods or you provide evidence that you sent them back, whichever occurs first. Refunds are normally made to the original payment method within 14 days after that point. Your bank or payment provider may take additional time to display the refund.
14. Faulty, damaged or misdescribed goods
Phone World is responsible for supplying goods that are of satisfactory quality, fit for their usual purpose and any particular purpose made known to us, and as described. Your rights under the Consumer Rights Act 2015 are not limited by these terms or by a manufacturer's warranty.
Depending on the circumstances and timing, your legal remedies may include the short-term right to reject, repair or replacement, a price reduction or a final right to reject. Contact us promptly with your order number and a description of the problem. We may ask for photographs, diagnostic information or return of the product so the issue can be verified. We will provide an appropriate return method where the goods are faulty, incorrect or damaged on delivery.
15. Commercial warranties
A product may include a manufacturer warranty or a separate Phone World commercial warranty. Any duration, eligibility requirements, exclusions and claim process will be stated with the product or in the relevant warranty terms. Where a qualifying accessory is advertised with Phone World's two-year accessories warranty, that additional promise applies alongside, and does not replace, your statutory rights.
Commercial warranties normally do not cover fair wear and tear, accidental or liquid damage, misuse, unauthorised modification, loss, theft or faults caused by incompatible equipment unless the published warranty specifically says otherwise.
16. Repairs and other services
Website repair bookings, diagnostics, data handling, parts, estimates, collection, unclaimed devices and repair warranties should be governed by separate Repair Terms presented before the booking is confirmed. If a repair product or service is purchased through the online shop, these terms apply alongside those Repair Terms. If there is a conflict, the specific Repair Terms apply to the repair service.
17. Acceptable website use
You must not misuse the website, attempt unauthorised access, introduce malicious code, interfere with website operation, scrape content at scale, use automated purchasing tools unfairly, submit false information, impersonate another person or use the website for unlawful or fraudulent purposes.
We may restrict or suspend access where reasonably necessary to protect the website, customers or our rights. We do not guarantee that the website will always be available or free from errors, but we will use reasonable care in operating it.
18. Intellectual property and customer content
Website content is owned by or licensed to Phone World Ltd and may be used only for personal, non-commercial purposes unless we give written permission. Third-party brand names and trade marks belong to their respective owners.
If you submit a review, image or other content, you confirm that you have the right to submit it, that it is accurate and lawful, and that it does not infringe another person's rights. You grant Phone World a non-exclusive, royalty-free licence to display and use that content for operating and promoting the business, subject to our Privacy Policy and applicable law. We may remove content that breaches these standards.
19. Privacy and cookies
Our Privacy Policy explains how we collect and use personal information, the lawful bases relied on, who information may be shared with, how long it is kept and your rights. Our Cookie Policy explains the cookies and similar technologies used by the website. These policies form part of the information provided to website users but do not reduce your rights.
20. Our responsibility to you
Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or breach of your statutory consumer rights.
If we fail to comply with these terms, we are responsible for loss or damage that is a foreseeable result of that failure or our failure to use reasonable care and skill. We are not responsible for loss or damage that was not foreseeable, for business losses where you are acting as a consumer, or for third-party services outside our reasonable control. We do not exclude responsibility for damage to your property caused by our negligence.
21. Events outside our reasonable control
We are not responsible for delay or failure caused by events outside our reasonable control, such as severe weather, transport disruption, network outages, cyber incidents, industrial action, supplier failure, public-emergency measures or changes in law. We will take reasonable steps to reduce the effect, keep you informed and provide cancellation or refund rights where required.
22. Changes to these terms
We may update these terms to reflect changes in law, technology, payment or delivery arrangements, or the way the website operates. The terms applying to an accepted order are those provided when the order was placed, unless a change is required by law or you agree otherwise. The latest website-use terms will be published with an updated date.
23. Complaints
If you are unhappy with a product or service, please contact us with your order number and a clear description of the issue. We will review the matter and aim to provide a fair response. If a complaint cannot be resolved internally, we will provide any information about an appropriate alternative dispute-resolution body that we are legally required to give. This does not prevent you from using the courts.
24. Governing law and courts
These terms and any contract between you and Phone World Ltd are governed by the law of England and Wales. If you live elsewhere in the United Kingdom, you also retain any mandatory protections available under the law of your home nation. You may bring proceedings in the courts of the part of the United Kingdom where you live or in the courts of England and Wales, as applicable.
25. General
If a court finds part of these terms unlawful or unenforceable, the remaining provisions continue in effect. A delay in enforcing a right does not waive it. The contract is between you and Phone World Ltd; no other person has a right to enforce it unless the law says otherwise.
